The Process and the result
You can arrange sessions from 1 to 2 hrs and we offer flexible hours including weekends and evenings. For some couples the only area that needs to be covered is equitable distribution. Other couples will need to mediate all four major areas. Since mediation is a facilitation of self determination your individual circumstances determine the speed and the range of what needs to be mediated. If children are involved we like to start with them and work out a parenting schedule.
In the first meeting we determine the road map to navigate your particular circumstances. You will leave with forms to take home and fill out and a list of thing to bring in like tax returns, bank accts and credit card statements. Full disclosure is essential to a fair resolution. The legitimacy of any agreement either mediated or litigated, is undermined if one party fails to disclose a significant asset. Cases tried in court are on the public record, the discovery process is exhaustive and a judge is obliged to report undeclared income. In mediation whatever is disclosed is confidential and furthermore nothing said nor any offer made during the process can be used if you decide to terminate the mediation and switch to litigation.
The final product of a mediation is the Memorandum of Understanding. All the decisions that you have made in the process are described in laymen’s terms. We will review and confirm your agreement to the terms as written down. This is what you will bring to your respective review attorneys. One of your attorneys, or sometimes a third attorney will draft the Memorandum of Understanding into a Separation and Property settlement agreement. This is a legal document which once signed becomes binding on both and will be filed with the court.
